Please read these terms carefully before using the Tbii Store website.

Section 01

Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Tbii Store, doing business as Tbii ("Tbii", "we", "us", or "our"), concerning your access to and use of the https://tbii.ca website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use from time to time. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use this Site. You may not use the Site in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Canada, the United States, international copyright laws, and international conventions.

The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

Section 03

User Representations

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

Section 04

User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Section 05

Fees and Payment

We accept the following forms of payment: Visa, Mastercard, American Express, and PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

Sales tax (including GST, HST, and PST where applicable) will be added to the price of purchases as required by Canadian law. All charges are in Canadian dollars unless otherwise stated. We reserve the right to correct any pricing errors and to refuse any order placed based on an incorrect price.

Section 06

Shipping and Importation

6.1 Importer of Record

When you purchase products from Tbii Store, you acknowledge that our curated items are shipped directly from specialized international fulfillment hubs. For the purposes of customs, border clearance, and local regulations, you, the customer, are recognized as the Importer of Record.

6.2 Customs, Duties, and Taxes

You are solely responsible for any import duties, customs fees, tariffs, and local taxes levied by your country's customs authorities. These charges are completely outside of our control, cannot be predicted by Tbii Store, and are not included in the purchase price or shipping cost at checkout. All such fees must be paid by the recipient upon delivery.

6.3 Customs Delays & Force Majeure

While we partner with global logistics leaders to ensure timely delivery, Tbii Store is not responsible for shipping delays caused by the customs clearance processes or unexpected regulatory hold-ups in the destination country. Furthermore, delivery extensions or disruptions resulting from Force Majeure events—including but not limited to severe weather, natural disasters, strikes, geopolitical conflicts, or global health emergencies—are exempt from automatic refund or replacement claims.

6.4 Refusal of Delivery & Unclaimed Packages

If a shipment is refused due to unexpected import fees, or if a package remains unclaimed at a local post office or pickup cabinet (including automated self-pickup systems), the carrier may abandon, destroy, or attempt to return the package.

Because international return logistics are highly complex, carriers frequently do not return these goods to our origin warehouses.

If a package is lost, destroyed, or abandoned due to a customer's refusal or failure to collect it in time, Tbii Store takes no responsibility and cannot offer a refund or a reshipment.

Section 07

Shipping and Delivery Policy

At Tbii Store, our brand promise is "Elevating Every Detail of Your Lifestyle." To deliver on this promise—combining premium innovation, exceptional design, and competitive pricing—we ship our curated products directly from our global fulfillment partners to your doorstep.

7.1 Shipping Destinations

We proudly ship to all provinces and territories across Canada and the United States.

7.2 Processing & Cancellation Windows

Standard Processing: All orders are processed within 1–3 business days. Orders are not processed or shipped on weekends or Canadian statutory holidays.

Cancellation Policy: You may request a full cancellation and refund strictly before the item enters the fulfillment and processing stage.

Non-Cancellable Items: Once payment is processed, Print-on-Demand (POD) / customized items, pre-order inventory, and custom media orders cannot be modified or canceled under any circumstances, as production and allocation begin immediately.

7.3 Estimated Delivery & Official Delay Windows

Because we source our products globally, delivery times vary based on your location and the specific international hub.

Note: These are estimated timelines. Most packages arrive sooner, but customs processing or regional carrier constraints can occasionally extend these windows.

7.4 Shipping Rates

Standard shipping rates are calculated dynamically at checkout based on the total package weight, dimensions, and final destination.

7.5 Tracking Your Order

Once your package departs our facility, you will receive an automated email containing your tracking number and a link to our tracking portal. Please allow up to 48 hours for the courier tracking information to update on the portal once the label is generated.

7.6 Multiple Shipments

To ensure you receive your lifestyle pieces as quickly as possible, orders containing multiple items may be shipped in separate packages. You will receive unique tracking numbers for each package at no additional cost.

7.7 Lost Packages & Delivery Discrepancies

If your tracking information indicates that your order has been successfully "Delivered," but you have not received it, please check secure drop areas, neighbors, or your local postal hub. Tbii Store cannot issue automatic refunds for packages marked as delivered by the courier.

To File a Claim for a Stalled/Lost Package: If a package is truly lost in transit and has surpassed the Official Delay Windows outlined in Section 7.3, or if you require an investigation for a delivery discrepancy, you must contact support@tbii.ca. For packages marked "Delivered" but not received, you must provide a formal non-delivery certification issued and stamped by your local post office. Investigations with international carriers can take 1–2 months, and a refund or reshipment is not guaranteed if the courier confirms accurate delivery.

Section 08

Returns & Refunds

8.1 Return Period & Eligibility

We offer a 30-day return window, giving you 30 days from the physical delivery date of your item to request a return authorization. To qualify for a return, the item must be in its original, pristine condition: unworn, unused, unaltered, featuring all original tags, and housed completely in its original packaging.

8.2 Proactive Return Strategy

Because our premium collections are managed across an international fulfillment network, returning items globally can incur incredibly high shipping costs, long customs delays, and a high risk of damage or loss in transit.

To save you time and expense, Tbii Store strongly discourages international return shipping. Instead, upon reviewing your case, our team will frequently offer alternative, customer-friendly resolutions—such as a high-value store credit or a partial refund—allowing you to keep the item without the hassle of shipping it back.

8.3 Return Process & Shipping Responsibilities

If an international return is deemed absolutely necessary by our support team, the following steps apply:

  • You must contact us first at support@tbii.ca to secure a written Return Merchandise Authorization (RMA). Items sent back to us without a prior authorized request will be rejected and discarded.
  • Customers are solely responsible for paying all return shipping fees. These costs are strictly non-refundable.
  • We strongly recommend using a premium, trackable shipping service and purchasing shipping insurance. We cannot guarantee, track, or assume liability for items lost or damaged on their way back to our international hubs.

8.4 Damaged, Incorrect, or Missing Items

If your item arrives with an issue, please save all packaging materials, take clear photos or videos, and contact our support team at support@tbii.ca within 7 days of delivery (up to 30 days for consumer electronics).

  • Badly Damaged Items: Eligible for a full refund or a complete product replacement.
  • Partially Damaged or Cosmetic Packaging Issues: Minor scuffs on outer display boxes, loose threads, or small fabric wrinkles that do not impact the core functionality of the product do not qualify for full refunds. A partial store credit or alternative accommodation may be issued.
  • Incorrect Items or Sizing Discrepancies: If you receive the incorrect size or SKU, please send us a photo of the product next to a measuring tape or showcasing the sizing tag. Upon verification, we will issue a full replacement or refund.
  • Missing Components: If missing parts or accessories do not impede the main function of the product, we will issue a partial refund or ship the missing part. If it restricts usage, a full replacement will be arranged.

8.5 Non-Returnable & Non-Refundable Items

To maintain quality control, safety, and hygiene, the following items are strictly excluded from our returns policy:

  • Perishable goods or personal care items (cosmetics, beauty products, skincare).
  • Intimate apparel, swimwear, or bodysuits.
  • Custom-made, personalized, or Print-on-Demand (POD) products.
  • Hazardous materials, flammable liquids, or gases.
  • Clearanced items, Final Sale products, and digital gift cards.
  • Products showing signs of physical misuse, customer-inflicted damage, or ordering errors (e.g., customer selecting the wrong item or SKU at checkout).

8.6 Refund Issuance

Once your authorized return is received, inspected, and approved by our quality control team, we will notify you via email. Approved refunds are automatically credited back to your original payment method within 10 business days. Please note that your bank or credit card provider may require additional processing time to post the transaction to your account.

Policy Disclaimer: All final assessments, claim approvals, and resolution determinations—including the validation of submitted photographic or video proof—are made at the sole and absolute discretion of the Tbii Store management team.

Section 09

Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Engage in any unauthorized framing of or linking to the Site.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site.
  • Use any information obtained from the Site in order to harass, abuse, or harm another person.
  • Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavour or commercial enterprise.
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Site.
  • Use the Site in a manner inconsistent with any applicable laws or regulations.

Section 10

User-Generated Content, Reviews, and Submissions

The Site may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site ("Contributions").

By posting Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, disclose, publish, and distribute such Contributions. Reviews must reflect firsthand experience with the product or service reviewed, and must comply with all applicable content guidelines. We reserve the right to remove or refuse any Contribution at our sole discretion.

Site Management and Termination

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use; (3) refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; and (4) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE TO ANY PERSON FOR ANY REASON OR FOR NO REASON. We may terminate your use or participation in the Site or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

Privacy Policy

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy posted on the Site, which is incorporated into these Terms of Use. Please be advised the Site is hosted in Canada. If you access the Site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in Canada, then through your continued use of the Site, you are transferring your data to Canada, and you agree to have your data transferred to and processed in Canada.

Copyright Infringements

Please be advised that pursuant to applicable law you may be held liable for damages if you make material misrepresentations in a Notification. Thus, if you are not sure that material located on or linked to by the Site infringes your copyright, you should consider first contacting an attorney.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you.

Governing Law

These conditions are governed by and interpreted following the laws of Canada, and the use of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law of your country of residence.

Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Indemnification

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors you see on screen will be accurate, as this depends on your monitor settings. We do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.

User Data

Miscellaneous

These Terms of Use and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.
